Are You Eligible For Chapter 12 Bankruptcy?
Chapter 12 of the Bankruptcy Code allows for debt relief for family farmers and family fishermen with a certain amount of annual income. You have to meet certain guidelines, but I can guide you through the process.
The process includes:
- Proposing a repayment plan to pay back creditors, generally over a period of three to five years
- Deciding whether to file as an individual, an individual and spouse, or as a corporation or partnership
- Quantifying the amount of secured and unsecured debt
- Reorganizing your business
The paperwork for Chapter 12 is very detailed, as you determine your assets and liabilities. Using my skills as an experienced bankruptcy lawyer, I can help tackle the issues needed to restructure your finances and debts in order to get a fresh start.
