Bankruptcy

Experienced Iowa Bankruptcy Attorney

What do you do when you have to choose between paying on your credit cards or paying your mortgage or between paying any creditors and putting food on the table and gas in your car to get to work? Filing for bankruptcy is not the answer for everyone, but for many individuals, small businesses and farmers in East Central Iowa, bankruptcy can provide relief from overwhelming debt.

Your Iowa Bankruptcy Lawyer

At the Iowa offices of Rush M. Shortley, Attorney at Law, I help people in our heartland communities find relief from unmanageable debt. With over 30 years of bankruptcy law experience, I will work with you to find an individualized solution to your situation. Contact me online to schedule an appointment. Depending on your situation, I will help you file for bankruptcy or guide you to and through an alternative debt relief option.

Pre-Bankruptcy Planning

Every form of bankruptcy requires at least some planning to make sure you receive the exemptions to which the law entitles you to keep the property you need for your fresh start. I will assist you to arrange your financial affairs to optimize your bankruptcy filing.

Chapter 7 Bankruptcy

Also called "liquidation bankruptcy," Chapter 7 allows individuals to discharge many kinds of debt. If you are struggling with debt from credit cards, home mortgage payments, car loans and other consumer goods, Chapter 7 can give you a fresh start.

Chapter 12 Bankruptcy

If more than 50% of your family's income comes from farming, Chapter 12 bankruptcy allows you to reorganize your finances and get relief from your debt.

Chapter 13 Bankruptcy

Chapter 13 bankruptcy is a "reorganization bankruptcy" for individuals-consumers, husbands and wives, the self-employed trades person, professional or small business owner. It allows you to restructure your debt and create a court-approved plan to pay all or part of your debts over a 36 to 60 month period from your disposable income after paying your living expenses and mortgage and auto loan payments.

Pre-Bankruptcy Workout

If filing for bankruptcy is not your best option, I will help you find alternatives and, if available, work with your creditors to find a solution. In certain cases, I may refer clients to a local non-profit debt counseling and consolidation agency. Contact me to schedule an appointment in one of my Eastern Iowa offices.
